Under the Canadian Charter of Rights and Freedoms , Free Speech is a Fundamental Right. That being said our Crimal Code does put certain restictions on this right. Under the Code it is a Criminal Act to publicly: 1. Advocate Genocide
2. Publicly incite hatred.
3. Wilfully promote hatred against an identifiable Group.
This law also pertains to the Internet but does not cover speech that was spoken in a private situation. Under our Law a Judge has the authority to order the removal of Hate Propaganda from all computers that are available to the public in Canada. So even though we have the fundamental right to freedom of speech it is not an absolute.
